Confusion between trademarks: the relevant part of the public has the lowest level of attention

The Court of the European Union in its ruling of 19 September 2019 established that in assessing the risk of confusing two distinctive signs, the part of the relevant public with the lowest level of attention should be considered.

Case T-359/18 dealt with the issue of the likelihood of confusion between two signs as an element impeding the registration of the subsequent mark.
