The Decree has provided for various innovations, among which, article 31 which provides for the insertion of art. 11 - ter of Legislative Decree 30/2005 (Industrial Property Code) which introduces the notion of "historic trademark of national interest". This rule is aimed at discouraging owners of Italian brands from selling their brand to foreign buyers and has the main objective of protecting employment.
Furthermore, the introduction of a new art. 185-bis of the Italian Criminal Code which provides for the creation at the Italian Patent and Trademark Office (UIBM) of a "special register of historic trademarks of national interest" in which, at the request of the owner or exclusive licensee of the trademark, can be registered trademarks by at least 50 years or for which it is possible to demonstrate continuous use for at least 50 years; used for the marketing of products or services made in a national production company of excellence historically connected to the national territory.
The logo of the "historic brand" will also be established by decree of the Ministry of Economic Development (MISE), which however is still under study today.
