UE Court rejects the Louis Vuitton claim

With the judgment of 21 April 2015, the EU Court decided that the figurative mark "checkerboard" brown, more commonly known as Damier pattern, registered at the OHIM August 27, 1998, is void.

This decision was based primarily on the lack of distinctive character of the mark. This characteristic seems in fact, despite what the well-known Louis Vuitton has tried in every way to show, not be perceived by the end user in the entire European Union.
